I. General Terms
When these Terms and Conditions refer to "IVATHERM" or "we", they refer to the company Ivatherm SA, with its registered office in Bucharest, Str. Ermil Pangratti, no. 30A, HBC Dorobanți building, 3rd Floor, Sector 1, registered with the Trade Register under no. J/9125/2012, having Unique Identification Code RO12408721, as operator of the ivatherm.ro online store ("Website" or "online store").
The Terms and Conditions apply automatically when you use the website or place an order through the website, desktop or mobile version, and represent the form of the existing legal relationship between you and IVATHERM ("Contract").
The Terms and Conditions, together with the Personal Data Privacy Policy, establish the rights and obligations of IVATHERM as seller and yours as buyer, as well as the bases for the processing of personal data carried out by IVATHERM.
The services provided through the IVATHERM online store are addressed to persons over 18 years of age.
Before placing an order, in the order form, you must check that you have read, understood and agree to the Terms and Conditions.
II. Copyright
All copyrights, as well as all related rights, including intellectual property rights, belong to IVATHERM. Also, all materials contained on the website, such as, but not limited to, images, texts, photos, design, icons and illustrations are the property of IVATHERM.
The use of any of the aforementioned elements without IVATHERM's consent is punishable according to the legislation in force. By exception, you may view and download the materials contained on the website only for personal, non-commercial purposes.
III. User Account Registration
If you wish to become a member of the online store to keep up with the status of your placed orders and to keep track of your completed orders, you can register by filling out the form available on the website in the "My Account" section, "Register a new account" sub-section.
After creating your user account on the website, you can log in using your email address and the password declared at the time of account registration.
All personal data provided by you are processed in accordance with the legislation on personal data processing, as detailed in the Personal Data Processing Privacy Policy.
IV. IvaClub Loyalty Program
After registering an account in the Store, you can benefit from a bonus points within the ivaClub loyalty program, managed by Ivatherm.ro. By participating in ivaClub, you receive a bonus point of 10% of the value of your purchases.
The bonus point cannot be exchanged for cash and can only be used for purchases on Ivatherm.ro. The bonus is calculated based on the value of purchases made and rounded to the nearest integer RON.
The bonus can be used for purchasing products with and without discount on Ivatherm.ro, in the form of a discount that lowers the purchase price, provided that the total amount of the discount cannot lower the price of the products by more than 50% of their initial price, which is the full selling price.
If the value of the bonus points in your account is greater than the difference between the price of the products you purchase and 50% of the value of these products at their full price, the surplus will remain in your account for later use. However, if the value of the bonus points in your account is equal to or less than the difference between the price of the products you purchase and their full price, you can use the entire accumulated bonus.
You will find all information about the current value of your bonus points in your account on Ivatherm.ro.
If you want to use your bonus for purchases on Ivatherm.ro, log in to your account and check the "Apply bonus points" option in the shopping cart. The maximum available bonus amount that you can use for this shopping cart will appear.
Please remember that the use of bonus points must comply with the Terms and Conditions. Otherwise, we will have the right to cancel part or all of the accumulated bonus, about which we will inform you via electronic correspondence.
The benefits offered by ivaClub membership will not accumulate with other promotions, unless we have expressly allowed a combination of these promotions.
We organize promotions for ivaClub members temporarily (e.g., multiplying points, receiving additional freebies with purchases, free shipping, gift product, free samples, etc.). Details of such temporary promotions will be communicated on the ivatherm website or in promotional information sent directly to all ivaClub members or selected members.
Ivatherm may suspend or terminate ivaClub at any time.
Gift products and free samples: For each order placed on the site, the customer has the possibility to receive a free sample or gift product, as applicable. Only one type of sample/product and one piece per order can be chosen, within the limits of available stock. The choice of sample/product is made on the order completion page. We reserve the right to replace the chosen sample with another similar product if the stock is exhausted.
Any attempt to defraud this rule – such as placing multiple orders with the aim of obtaining more samples or using multiple accounts for this purpose – may lead to the cancellation of the order and the possible blocking of the customer's account.
V. Placing orders on the website
You can place orders online with or without creating a new account, however, to complete orders placed without a user account, you must fill in the requested information to enable us to deliver the desired products to you under the best conditions.
Product prices are displayed in RON (lei) and include VAT (value added tax). IVATHERM may change the prices of products sold through the online store at any time.
For orders over 249 RON (lei), shipping is free, and for orders under 249 RON (lei), shipping is included in the invoice and varies depending on the distance to the locality where they will be delivered.
The first step to placing an order is to add products to your shopping cart. To complete the order, you need to fill in the requested data and make sure they are correct, complete, and up-to-date.
You will receive an order confirmation email immediately after placing it, which will include details about the order (products, price, shipping fee). Once you receive the confirmation email, your order has been correctly registered and will be prepared for shipment.
VI. Product stock and special offers in the online store
IVATHERM has the right to change or modify special offers in the online store at any time. Order processing will be done at the price displayed at the time of placing the order.
It is possible that some products are not in stock, but this will be indicated appropriately on the product page. If a product is out of stock when you want to purchase it, you will not be able to add it to your shopping cart.
IVATHERM reserves the right to cease selling a product at any time.
VII. Payment and delivery methods for orders
Orders placed on ivatherm.ro can be paid either in cash, by cash on delivery, or by online payment. In the case of online payment, the transaction is secure, and the personal data associated with the bank card are not stored in our databases and cannot be viewed by IVATHERM. For orders paid by cash on delivery to the courier, a fee of 3 lei is charged, corresponding to the processing fee imposed by courier companies.
For the delivery of orders, we collaborate with courier companies that comply with the legal provisions regarding personal data protection. The estimated time for handing over packages to the courier is 1 to 5 working days from order confirmation.
In exceptional situations, such as, but not limited to public holidays, unfavorable weather conditions, strikes, errors in the order processing system, or in the event of a very large number of orders, we may not be able to ship orders in a timely manner. In such cases, we reserve the right to delay the shipment of orders, and customers will be informed accordingly. The maximum execution period must not exceed 30 days.
It is important to mention that IVATHERM cannot be held responsible for any delays caused by courier companies or other unforeseen circumstances.
VIII. Return Procedure
Right of withdrawal from the contract:
"Withdrawal from the contract" refers to your legal right to cancel an order placed on our website by returning goods. This is regulated by Government Emergency Ordinance no. 34/2014 regarding consumer rights in distance contracts.
Returns can be made within 14 working days from the date you received the order without having to justify your decision to withdraw, and it is FREE.
Given that the products sold by Ivatherm are personal care products, special return conditions legally apply to them. For reasons of customer health protection, these products can only be returned if they have not been unsealed.
Product return process:
- Notify us of your decision by email at – office@ivatherm.ro. Ivatherm will confirm receipt of the withdrawal request to the Customer by email within 2 working days, also providing you with a return authorization number (RMA Number) which you are kindly asked to note on the package sent to us.
- Ivatherm will send the courier to the address indicated by you to pick up the package. In this case, the shipping cost is FREE.
- After the package arrives at our warehouse, marked with the received RMA# return authorization number, it will be received and checked to ensure that the return conditions have been met.
- Once verified and accepted, the return will be processed according to your decision: product replacement or refund. The Customer undertakes to return the products to Ivatherm in impeccable condition, unused/untested, with their original seal and packaging, i.e., in a condition where the products can be resold. The products will be returned together with all accessories, samples/free gifts, in their undamaged original packaging to the address: Strada Sinaia 53-53B, Ștefăneștii de Jos, Ilfov, together with the completed return form or the RMA number received from Ivatherm noted on the package and the invoice where you marked the products you are returning.
- After verification and acceptance of the return, if you choose to return the purchase value, we will process the refund within a maximum of 14 days by the means chosen by you. The refund will include the value of the products and the initial shipping to you, if it was not free.
- The existence of this right of return does not deny or replace other rights you have in your relationship with Ivatherm, the products still benefiting from a conformity guarantee.
- Given the nature of the products sold – cosmetics and dermo-cosmetic care products – there is a possibility of reactions generated by the user's skin sensitivity, manner of use, interactions with other products used – individual reactions arising from each user's individual situation and which do not necessarily imply the existence of a product non-conformity.
Our recommendation is to use our treatment products after a discussion with a professional in the field – dermatologist, pharmacist, or pharmacy consultant – to be as sure as possible that your choice is appropriate and beneficial for your skin. We are also at your disposal for purchase recommendations and post-use consultation through all our communication channels.
IX. Updates to the Terms and Conditions
It may be necessary to revise the Terms and Conditions in the future. If we modify the Terms and Conditions, we will publish the revised Terms and Conditions on the website and will indicate the updated version by changing the "Last updated" date at the top of the Terms and Conditions. After the date on which the updated Terms and Conditions come into effect, accessing the website will constitute your acceptance of the updated Terms and Conditions.
